Drinking and driving in Montreal

The consequences of being found guilty of an impaired driving offence should not be underestimated. You have to face not only the sentence imposed by a judge but also the minimum sentence imposed by the Société de l’assurance automobile du Québec (SAAQ). Be aware that the severity of the penalties depends on various factors, including blood alcohol content and the gravity of the resulting consequences.

Defining the offence according to the law

In Quebec, both the Criminal Code and the Highway Safety Code address all infractions involving a blood alcohol level surpassing 0.08, which equals more than 80 mg per 100 ml in the bloodstream. Additionally, the use of drugs and medications is regulated by the law.

It’s worth noting that even if your blood alcohol level exceeds the legal limit, contesting your ticket is possible. This hinges on the recognition that each police officer, during an intervention, must adhere to specific obligations to ensure your rights are respected. Non-compliance with these obligations may work in your favour and even lead to the dismissal of the charges against you.

The penalties for driving under the influence

Financial Burden

An impaired driving conviction can have significant financial consequences. Research by CAA Quebec has revealed that a 24-year-old man may face expenses of up to $6,200 as a result of legal violations in this context.

License Suspension and vehicle impoundment

Following an arrest, your driver’s license is suspended for a minimum of 90 days, and your vehicle is promptly impounded at your own cost if no one else is available to drive it.

The ignition interlock device

Lasting from four to six years, depending on individual circumstances, the installation of an ignition interlock device encompasses not only its setup costs but also an increase in your insurance premiums. The duration of interlock device usage is determined based on various criteria, such as age, the severity of the offence, and the consequences of your actions.

International travel restrictions

In some countries, you may be barred from obtaining visas or crossing borders. While it’s relatively rare for a first-time DUI offender to encounter international travel restrictions due to a criminal record, it can still occur.

Numerous accidents caused by impaired driving have resulted in injuries or fatalities, affecting a large number of people, whether directly involved or innocent bystanders.
